Muslim organization and Samajwadi Party MP criticize Uttarakhand's Uniform Civil Code Bill, terming it as contradictory to Quranic guidance.

Samajwadi Party MP ST Hasan stated that the bill presented in the state Assembly by Uttarakhand Chief Minister Pushkar Singh Dhami goes against the principles outlined in the Quran. He emphasized that they would not comply with the Uniform Civil Code Bill if it contradicts the guidance provided in the Quran.

Uniform Civil Code Bill criticism
On February 6, Uttarakhand Chief Minister Pushkar Singh Dhami presented the Uniform Civil Code Bill in the state Assembly.

Following Uttarakhand Chief Minister Pushkar Singh Dhami's introduction of the Uniform Civil Code (UCC) Bill in the state Assembly, Samajwadi Party MP ST Hasan expressed concern on Tuesday, stating that the bill contradicts the teachings of the Quran, the sacred text of Muslims. Hasan emphasized that they would not adhere to the UCC Bill if it goes against the guidance provided in the Quran. He stated, "We won't abide by it (UCC Bill) if it is against the 'hidayat' (instructions) given to Muslims in the Quran. We don't have any issue if it is as per 'hidayat'."

The All India Muslim Personal Law Board (AIMPLB) has joined in criticizing the bill. Maulana Khalid Rasheed Farangi Mahali, an executive member of the board, reportedly mentioned that certain communities would be excluded from the Uttarakhand Uniform Civil Code.

Maulana Khalid Rasheed Farangi Mahali expressed the view that achieving complete uniformity in all laws is impractical. He argued that if certain communities are exempted from the Uniform Civil Code (UCC), it contradicts the very idea of a uniform code. He further stated that in his opinion, there was no necessity for such a uniform civil code. The AIMPLB would assess the draft once it's presented to the Assembly, and then decide on their subsequent actions based on input from their legal team.

Maulana Badruddin Ajmal, the president of the All India United Democratic Front (AIUDF), strongly criticized the Uniform Civil Code bill presented in the Uttarakhand Assembly, suggesting that it should be discarded entirely.

Ajmal likened India to a vibrant garden, emphasizing the diversity of its people, cultures, and faiths as its essence. He warned against going against this natural diversity, stating that such actions are not sustainable in the long run. Ajmal also criticized the tendency of state governments, including that of Assam Chief Minister Himanta Biswa Sarma, to introduce controversial bills to gain favor with Prime Minister Modi and to maintain their positions of power.

In conclusion, Ajmal called for the dismissal of the Uniform Civil Code bill, asserting that it does not align with the inclusive spirit of India and should be consigned to the dustbin.

Congress does not oppose the Uniform Civil Code.

The state Congress unit clarified today that they do not oppose the Uniform Civil Code itself, but rather the manner in which the bill is being presented in the Assembly.

According to Yashpal Arya, the leader of Opposition in the Assembly, they believe in adhering to the rules of conduct in the House. However, they accuse the BJP of disregarding these rules and attempting to stifle the voices of MLAs by relying solely on their numerical advantage. Arya emphasized that MLAs have the right to express their opinions in the House during Question Hour, whether through Rule 58 or other rules, and they should be able to raise various issues affecting the state in the Assembly.

Harish Rawat, the former chief minister of Uttarakhand, criticized the state government and Chief Minister Dhami for not adhering to proper procedures in their haste to pass the bill.

Rawat pointed out that members of the Assembly do not have access to the draft copy of the bill, yet the government is pushing for an immediate discussion on it. He expressed concern that the central government is using Uttarakhand, a sensitive state, merely for symbolic purposes. Rawat suggested that if the Uniform Civil Code (UCC) is to be implemented, it should be introduced by the central government.

It's noteworthy that the ruling Bharatiya Janata Party (BJP) had pledged to introduce the Uniform Civil Code bill during the 2022 Assembly elections in the state. Once enacted, this bill will replace personal religious laws governing various aspects such as marriage, divorce, and inheritance.
